County Jail Guard Accused of Raping Female Inmate

For the second time in three months, a guard at a Santa Fe County detention facility has been accused of raping a female inmate. The most recent rape accusation was reported Saturday by a female inmate at the Santa Fe County jail to the Santa Fe County Sheriff's Department.

According to a report, the female inmate accused a 39-year-old male jail employee of raping her on Friday. Santa Fe County Sheriff Greg Solano said Monday that he could not discuss the details of the case.

"It's still under investigation, and it's pretty preliminary right now," Solano said.

Solano said the victim was taken to St. Vincent Hospital and was seen by a sexual assault nurse examiner, but "due to circumstances surrounding the case, a rape kit was not done."

No administrative action has been taken against the jail employee, Solano said. The employee, who works for Management & Training Corp., the private company that manages the jail, did not work on Monday; he will likely meet with jail personnel today to discuss the incident, Solano said.

Solano said the sheriff's department may make a recommendation as to whether charges should be filed in connection with the incident, but most likely the decision will be up to the district attorney.

Solano said he does not know the age of the female inmate or why she is in the jail. A woman with the same name as the accuser was charged in January with commercial burglary and shoplifting.

In April, a guard at the Santa Fe County Youth Detention Center was charged with raping a 16-year-old female inmate. The guard, John Robertson, 39 at the time the charges were filed, was charged with two counts of second-degree criminal sexual penetration.

Officials at the juvenile jail who could say whether Robertson is still employed at the facility could not be reached for comment Monday.
